Default Building Contractor Misapplication Of Funds
As a Florida building contractor, Sub S Corp., I have personally signed construction draw affidavits even though potential leinors were not yet paid. This has never been a concern of mine as I have always ultimately paid our creditors. The over night evaporation of sales coinciding with multiple other industry troubles has prevented the company from making payment to these now publically recorded lienors. I am concerned about charges of fraud and misapplication of funds. Is the prosecution of these charges a difficult process? Since the cumulative amount is approximately $250,000.00 am I certain to face jail time?

If you embezzled $250,000 and are unable to pay it back, jail time is a real possibility.
