Here is my story and I would like your opinion on a possible outcome.
My wife and I got into a fight. It became physical. She hit me and I hit her back with an object. I know what I did was wrong and that I should never hit my wife. I wish I could turn back time. She only had some bruises. I got physically hurt on my head and had to go to the hospital. At the hospital I called the police to asked them for advice what to do in a situation like this. I got arrested for domestic violence. No charges were filed against me and I did not filed charges against my wife. I didn't do this because I didn't want to separate our daughter from her mother.
This is my first time I got involved with the law (New York). I want my family back. My wife wants it too. How big are the chances that my case is getting dropped and my record being sealed?
Even if I get a conviction I just want to protect my daughter from being separated from me or my wife. Should I tell the judge that I don't want my wife and my daughter getting punished for what I did? I just want to make things right again.
Consult a criminal defense lawyer, particularly if this is a first offense, as you may qualify for a "first offense sentencing" or diversion program. There may be information about sentencing alternatives on your county court's website.
