    Thumbs down Fired At Christmas Party

    Ok so here is my story. It is actually about my mother she works for a small company with less than 50 employees in GA she has been there less than a year. She ruptured a disc in her back 4 weeks ago and has been on pain medication every 4 hours. She is told by the Dr certain steps have to be followed to get the surgery they know she will need, and she is not allowed to work. She has short term dis. that her employer has supposedly sent in the paperwork for. She was asked to attend a christmas party there today and while she was there was told that at her next visit to the Dr if she was not cleared to come back to work she would no longer have a job! This would be her 6 week mark out of work. So my question is what rights does she have? Would she continue to have short term disability and health insurance for the surgery she will need?

    That depends entirely on the disability and insurance plans. The law does not address this question.

    She will be eligible for COBRA, which allows her to continue the health insurance plan at her own expense.
