Grandmother Versus Biological Father

If a mother goes to prison and the child is in her coustody can the childs coustody be signed over to the grandmother if the father is unable to care for the child? The parents are not together. Can the father take away rights from the grandmother being that he is not on the birth certificate or has not proven that he is the father?

If a father wants coustody of a child and already has two children living with him alone that he collects state benefits for he has no job that he reports due to the fact that he owes back child support on a third child , Is a single father who is gone during the day has no transportation and is a known drug user. Can the grandmother take coustody of the child if he objects being that she is financially stable, owns a home, has transportation, and a clean record. She would not be seeking state assistance or support from the father.

The father can seek to establish his paternity, then to seek visitation and/or custody. The grandmother can seek guardianship through the courts.
