    Default Filing For Divorce

    When filing for divorce, do you need to file in the county you were married in, or can you file in any county as long as it's in the state in which you were married? The state is California.

    You need to file in the county where you are domiciled.

    Or, if you are separated and you prefer, in the county where your ex- is domiciled.

    And it doesn't have to be in the state where you were married. You can file in any state if that is where one of you is domiciled. If you have any marital property to divide it is much better to file where the property is located. If there are children, filing needs to be in their home state.
