    Exclamation Car Alarm Doesn't Sound

    I am looking to get some sort of advice on my current situation. I had a directed car alarm system installed around a year and a half ago by Circuit City. Last night, my car was broken into and had roughly $2000 of my things taken from it. The alarm system itself never fully sounded. According to the statement in the manual the company does not accept any liability for theft of the vehicle or the contents inside, and that the alarm is merely a deterrent against theft. My question is because the alarm did not sound when the window was broken and the car radio was removed, do I have any recourse against either the alarm company, directed electronics, or the instaler, circuit city?

    This I do not know. I think the alarm was defective. A shattered window alone should have set off the alarm, not to mention opening the trunk and ripping out the radio. The alarm was activated too. Something just doesn't add up in all of this to me.

    The question of having a legal claim against any of the parties, beyond a warranty claim on the alarm, is iffy to begin with. But beyond that, you have the burden of proof in court. You must have evidence to show why the alarm failed, and how it was the fault of the defendant(s) that it failed. You would also have to establish that the theft would not have occurred but for the failure of the alarm.
