Default Assault On A Family Member In Loudoun County, Virginia
Hi, I was given a Warrant of Arrest - Misdemeanor (State).(Class 1 misdemeanor VA crime code ASL-1315-M1 and code section 18.2-57.2). My boyfriend and I got in an altercation and I was stupid and called the police in anger. No one pressed charges, the police did see scratch marks on him and a bite mark from my self defense. I was told by the deputy at the time that I was very lucky that he was not my husband and that we do not have kids together and they left telling my boyfriend that he has a year to press charges. A day later I received a phone call from the deputy (Loudoun County) that he was not aware the law changed and I should have been arrested at the time. He said that he was going to stop by and pick me up and take me to the magistrate in the next few days but he ended up serving me with the paperwork with a court date 2 days from today. My boyfriend is not pressing charges and is coming with me to court to see if he can help. I have called the Juvenile and Domestic Relations District Court and they don't have my case on file yet. I am really scared and don't know what to do. Could someone please advise.

If they pursue charges against your boyfriend's wishes, get a criminal defense lawyer to help you defend yourself against the charges. If not, breathe easy.
