In a nutshell I have an unpaid CC. An attorney representing the CC company attempted to collect the debt. I was eventually issued a summons from the attorney that I answered and so I was able to avoid a default judgement. I recently went to court in Kingston, NY for a pre-trial conference (the attorney for the CC Company was not present) and the Judge set a trial date for Nov 29th.
I'm having difficulty finding a lawyer locally that is well versed in consumer law and I can't really afford one anyway. Since I do owe this debt isn't it a foregone conclusion that the Judge will find for the plaintiff anyway? So what am I at risk of losing? I'm self-employed, own a home (morgaged) and a currently unrented rental cottage, I own two late 80's volvos and a '94 dodge caravan and I have no other assets of any real value, certainly very little cash on hand
If you lose you will have a judgment on your credit history, which will adversely affect your credit. The law firm or a collection agency may well try to collect against your non-exempt assets, garnish your wages or bank accounts, put liens against your property, or some combination thereof, as permitted by law.
