    Default Landlocked Neighbor Wants To Force an Easement

    i own land in wisconsin and the land next to mine is land locked the landowner wants easement to put in a road to log off his land i refused and he says he is going to take me to court and make me grant him easement this would cut across about 1/2 mile of my land this land has been this way for at least 30 yrs can he do this

    It depends on how the land became "landlocked." I suggest that you get a copy of your deed and his deed from the court house and consult an attorney. It may be in your best interest to grant an easement under your terms rather than the terms set by a court.

    That last sentence assumes, of course, that the neighbor has a valid legal claim to obtain an easement.

    That depends upon the facts of the case, as lwpat indicated. We don't know the facts.

    If his property at one time in the past was also a part of your property and the sale of your property caused his to be landlocked. This is called an easement by necessity. He may have other claims but those depend on past use or anything of record. That is why I suggested that you get the deeds and take them to an attorney. He can check the chain of title for you and also see if there are any recorded easements.

    If your neighbor is landlocked and willing to lease an easement. Why wouldn't you want to do it. I take by you saying lease he's willing to give you money. Would it cause you some to allow him access?

    And if he's just asking where's the harm? Or is he saying if you don't lease it to me I will sue for it?

    I'm curious to your perspective
