Hi, think i'm pretty confused by it all. i have made an offer to offeree A to buy my car. he was hesistant with the price but i told him the offer would be open for another 2 days. however, as this model of my car is so rare, offeree B wants to buy it the next day. The negotiation and transaction process was witness by A's friend who wasn't near enough to hear what was going on but was suspicious by our actions.
A's friend inform A about it. After I've agreed to sell my car to B, A, being threatened, SMS me to tell me that he has accepted my offer. this is the complicated part, i didn't turn down A directly.. a few days later, B immigrated and the agreement was kinda void. A didn't want the car too at this time..
Can i enforce the contract on A? i mean, can revocation of offer be done by a 4th party, in this case A's friend, but can i argue that A's friend is not a reliable party since he didn't noe what exactly was going on between me and B? (the objective test) All previous cases of this type is normally of the offeror revoking the offer, but in this case, the offeror me, don't want the offer to be revoked but is the offeree who claims that the offeror revoked the offer already.. how can i turn the tables around? are there similar previous cases?
