    Post Felony Burglary of a Motor Vehicle in Texas

    Hello! In 1994, when I just turned 17, i received 8 yrs felony deferred adjudication for burglary of a motor vehicle. 2 months later i went to the Harris County boot camp for shoplifting and my probation was reinstated. In 1996 (age 19) I stopped going to probation for 3 months and went to jail for 72 days and was again reinstated. I have since turned my life around (except when I was 21 I went to jail for driving w/ a suspended license--I really didnt receive notification that it was suspended) and served a day in jail and was reinstated yet again. I completed the probation in 2002 and I am a 30 yr old working mother of a 6yr old and 3 yr old. I have not been a menace to society since I was a teen, and now I have heard that burglary of a motor vehicle is not even a felony anymore. Of course my record prevents me from living anywhere nice, aven though I have a good work history, income, and credit. Is there any hope that I can have my record expunged or sealed so I can live in a better apartment and apply for my real estate license? Help!

    You indicate that you violated your probation. When your probation concluded, were you still given a dismissal on the basis of the original deferment, or were you convicted?

    I don't think i was convicted, no one told me at the felony courts when i was reinstated that it was not deferred probation anymore. So I've always assumed my probation was still deferred adjudication.

    I can't suggest what remedies you may have for your record if you don't know what your record is. You should consider consulting a lawyer in Texas who handles expungements.

    But I thought I explained all of that. Why did you even reply to me? Either I have a deferred adjudication, or I have a felony conviction. I don't need sarcasm.
