Default Battery Charges
The other day my husband was arrested due to domestic violence the state attorney's office has charged him with Battery. He was placed a restraining order from the court, I wanted to know what other charges are normally assesed to the deffendant and what is the maximum jail sentence can he receive? Can you help??

The charges he faces are the charges leveled against him. if he was charged with battery, then that is the crime he was charged with.

What penalty he faces depends on the laws of your unnamed state, specific charge (code section(s)), and any past criminal history he has. he likely faces the potential for jail or prison time.

He needs to hire an attorney, and you need only tell the truth in court.

Is there any way for him not to get prision if this is his first time. What are the laws here in Florida? Do you know?

Was this his first charge on his record. Who was listed as the victim in the case was it you. If it was you, you or victim need to send a letter to the State attorney office attesting to his character and requesting that the State drops charges on him. Similar thing happene to me with my mother. She sent in letter and because I had no prior the procescuter never filed the case
