    Default Not At Fault Accident While Uninsured

    I was in an accident yesterday. I am a CA licenced driver, dont have insurance and was rear ended on the 5. I needed to come to a quick stop and the driver behind me rear ended me. No one was hurt. Her car has maybe a scratch on the front bumper and the bumper on my car was bent under. The damage appears to be minimal. She is young (perhaps 17-21) and on her parents unsurance. Her dad works for a car dealership so I think he will be savy to the laws as well as have access to inexpensive repairs. I got her insurance info and we exchanged phone numbers but I did not give her my insurance info as she didn't ask. I told her if she wanted to have my bumper fixed so that it would not go on her insurance that would be fine bc her insurance would go up for an at fault accident. I told her that i would get an extimate today and if she wanted to take care of this w/o her insurance that would be fine bc damage was minimal and no one was injured. Last night she left me a message for me realizing she didnt get my info. All she knows is my 1st name and cell phone. I could 1) never call her back and hope her dad doesn't try to find me via my cell phone as i am sure these things are possible or I could 2) call her and tell her the truth and hope her and her dad will fix my bumper and not report this me to the authorities or 3) call her and lie about having insurance. I think she, via her insurance company, is legally responsibile to fix my car but my concern is they could report me and I will get in trouble. Is that possible? Can I get in legal/DMV/SR-22 trouble if they report me? Can they report me and if so, to whom? There was another driver in her car as witness. Can you please offer advice on what I should do next.     I'm not going to try to guarantee you that you'll stay out of trouble for driving while uninsured, but if fault was all hers you do have a valid claim against her insurance.
