    Unhappy Can I Break My Lease Over Excessive Water Damage in Washington State

    Hello, I live in Washington State. We recently had a large rain storm blow through on Sunday night. We live in a triplex in the basement. We had water leaking through the bedroom window and from the foundation. Both bedroom carpets are really wet.

    I contacted my landlord and she sent a repair person who just dropped off a wet-vacuum. We've continuously vacuumed all day and are also blowing air on the carpets using industrial large fans - carpets remain wet.
    I've contacted the landlord to tell me what her plans are on getting the underlying issues resolved (i.e. fix the window and foundation leak) and haven't heard back.

    We've moved our mattress out into the living room and are now camping out there.

    We have just over 3 months left in our lease and am trying to figure out what our options are:
    - can I move out as the living conditions (in my opinion) are not acceptable at present.
    - will I be obligated to pay the 3 months of rent if I choose to move out?
    - can she damage my credit?
    - do I need to get a professional to come evaluate the situation?

    You may be able to get out of the lease by claiming a violation of the warranty of habitability. I suggest, though, that you consult a local lawyer because if you try to do this and a court ultimately rules against you, you could be held liable for the balance of the lease.
