IACP Approved Radar

I purchased a copy of the "Radar Operator Training Course" (w/supplimental) used to train officers for NC at the NC justice academy. In the supplimental from June 2007 it states that "in addition to other restrictions listed in this document, all speed measuring instruments apporved for use after january 1, 2006 are made subject to and restricted as follows"

G.) "Instrument must not have a fastest vehicle mode feature or any indicator of same on the instrument or remote."

The Kustom Signals - Golden Eagle has this feature. This is the device used in my traffic stop.

Is this grounds for dismissal?

The key words here are "approved for use after January 1...." In other words, if the device used on you was "approved for use" prior to 1/1/06, it does NOT have to meet those requirements. At least, that's how I read it.

So, you would somehow have to find out WHEN the Kustom Golden Eagle was first "approved for use". Note that "approved" is still different from "PUT into use". It might have been purchased last week, but as long as the device itself was "approved for use" prior to 1/1/06, it's still within the law.
