    Default Parent Paying Child Support is Caring For the Child

    Isn't there some law being broken when the parent that has custody is still receiving child support while the parent paying child support has been given child to care for by the parent receiving child support. Or is the law only broken if parent paying child support wants to pursue it?

    Has the parent paying the child support petitioned the court to modify or terminate support based upon the change of circumstances? If not, why not? The payor should not expect any retroactive modification of support.

    Also, laws are different in each state.

    No, the parent who currently has child is not petitioning court for a change. Somehow I think there's something funny going on there.

    Until that has been done, the person paying support is still responsible for said support.
