Default Alleged Domestic Violence and PPO in Michigan
I was recently expecting to go to a jury trial on a false allegation of Domestic Violence by my stb ex-wife. The DA attempted to get me to plead guilty to charges prior to trial but I held ground and denied all plea bargains to prove my innocence. The charges were dropped that day and no trial took place.

There has also been a 1-yr ex-parte PPO in effect by my wife since the alleged incident took place.

My Questions...
Does the PPO automatically drop if the DV charges are dropped?
-or-
Do I need to refile a motion to have the PPO terminated due to these new circumstances?

Default PPO and Domestic Violence Charge
The PPO is not affected by the resolution of the criminal charge, although a court may well be willing to reconsider the allegations in light of the acquittal. You should discuss with your lawyer the procedure for petitioning to have the issuing court reconsider the PPO.
