Can Discover Card Sue Us

Hi everyone,

I want to get some feedback for a friend. I read some of the other topic but it doesnt seem to have what I am looking for. Its for a friend and she owes $5k with Discover Card. A policeman brought her the papers a few days ago saying she must appear in court 20 days from the time she recieve those papers. The only property she has of value is her car, no house or nothing of value. So can they really sue and what can they sue her for this matter to collect money from her. Yes, they can still sue her & if she doesn't show up in court, they will get a default judgment against her.

If they get a judgment, they can seize all non-exempt assets allowed in her state & possibly garnish wages - it's according to the state which you didn't name.

Judgments are normally good for quite some time (again time according to state) & even if she hasn't any assets currently, she may in the future.

When was the last action taken on the card (ie date of last payment)? It's possible the SOL *might* be up for collection of the debt but again depends on state & when last action taken.
