I will try and make this short. My husband found out a couple of years ago that he had fathered a child several years prior. He did not know about this child until he was 6 years old. We went to court and he was ordered to pay child support. The mother was ordered to have the minor child's name changed to reflect my husband's last name. We also have stipulations in the court orders that we are to notify each other 30 days in advance (or as soon as we know) of a move, telephone change, or job change. She is also supposed to let us know where he attends school/etc. in case of an emergency. We only hear from her if the child support check is late. She also said that I as the stepmother am not to have ANYTHING to do with the child. She lives in Tennessee and we live in Georgia and my husband works EVERY weekend so it is impossible for him to go pick the child up (he must work to pay child support!) He still has never seen this child or even spoken to him on the phone (the child was always away when he called and by this point we have given up trying to communicate). She also never changed the child's name as ordered and we found out recently she was married and had moved nearly 6 months we didn't know about it!!
I know that the mother is working and we have recently had a new addition to our family. Is there A) Any way for my husband to relinquish his rights without her permission or B) A chance that we could take her to court for lesser payments?
Also she threatens to have him arrested if he's late on payments. Can she do this?? And what about her never changing the child's name and not telling us she was married??
