Default Malicious Wounding
Recently my boy friend (joe) got in a fight in my car with his best friend.(James). They were in my car and they started fighting. I got out and let James out. He then started hiting Joe non stop. Joe stabed James with a knife no bigger than an inch and didnt even stick it all the way in. He still steaidly hit my car and joe. Joe was tryin to get me to drive away but i could get to my car because of james, who pushed me outta the way.

I finally drove off and later learned I had to talk to the police. While I was giving my statement, joe was arrested. James suffered two little cuts on his cheek and a small stab wound to the stomach. From what i know, joe, is being tried for malicious wounding. I was wonder if anyone knew if this would be the charge or if he could get away wit self defense or assault. Also Joe had just got out of jail and was on bond, so will he be able to get bond again?? Another thing is i might be lookin at getting charged with helping him get away. I was wondering how much time we are both looking at. PLz help

Default Malicious Wounding
As Joe is facing what appears to be a felony charge, with potentially serious consequences, Joe should consult with a criminal defense lawyer or obtain a court appointed lawyer. He can form a strategy with that lawyer to advance a defense of self-defense.

As far as I know james never even gave the cops any statement other than who stab him. Hes not even pressing charges on joe. If james dosent go to court to testify against joe, is there really a strong case against joe. And is it still self defense even though he used a weapon.

Ok. First of all as you already know malicious wounding is a very serious serious charge...Its really another name for attempted murder. First off im facing some time for stabbing 3 girls..So basically im going upstate...but i don't know yet i have to go back to court for my sentencing...Ok..Joe your boyfriend right may get community service or a possiblity of house arrest but it depends if he has any other felonies on his record or other bad records involving police..now if he never been arrested or anything than that wil go for him in court and he may can get a good deal and they may let him off on house arrest and a restraining order to stay away from James. Ok. Me personally i haven't have anything on my record but assault and battery...and the reason i stabbed the girls was SELF DEFENSE and the judge saw that...im on house arrest now but im on a trial bases to see wether i will do good on house arrest..i have already pulled a month in jail when the incident happen. Now come Jan.19 i will either be senteced to Juve Life or more time on house arrest...My lawyer is saying i will basically get house arrest cuz im a good 15yr old never had anything serious on my records and basically nothing i have done is bad enough to have charges pressed agianst me..although i have come close...But keep in mind.. wether joe was in the right you have to remember its all in how the judge is feeling and how you carry yourself in court..You must represent yourself.. as if you are very caring and try the puppy dog face it worked for me :P but i'm just telling what i have learned from past expereince hope i have helped...Email me if you have anymore questions...hope everything goes well....Damn i should have been a lawyer...
