Default Does Diagnosis Suggest That a Settlement Is Coming?
Hi

OK, the Docs at Med center have scheduled an MRI for my husband on this coming Monday. It was discovered that when the accident had happened, he had some bleeding in the back part of his head, internally. My question now is, does this possibly mean he might be a bit closer to them settling this case, instead making us try to live on 2/3 payments 2 times a month? The lawyer my husband talked to said as long as they are paying, its good. I do not think these people understand taht my bills are more than this payment they are giving us. Let alone the gas, wear and tear on car, going back and forth to Docs, which only gets us 35cents a mile, but its cost us much more.
I am not able to find anyone who can answer these questions, i know that they can be specific, but i am just looking for something to understand and hold on to.

I think maybe I am asking the questions in an incorrect manner, so I will try one last time. Can my husband expect, if and when he reaches MMI, and is found to be unable to work anymore, a settlement? Is that how it works? Or do they expect my husband to keep with teh weekly payments until the run out.
I hope that made more sense than the last few notes

Unfortunately, I can't give you a more specific statement than can the attorneys you consult, who have the added benefit of being familiar with your state laws, state WC procedure, the medical record, and the history of the case.

It seems from what you have written that your husband's benefit is being assessed at the maximum weekly amount given his prior income. Please note that the lawyers may be satisfied with the fact that the employer is paying the maximum weekly benefit, because they can't get more than the maximum weekly benefit. If the maximum benefit available under law 's not enough to pay the bills, that's not something the lawyers can control.

Default about your TTD checks
Your TTD benfits will continue weekly or bi-weekly , until MMI is reached . In the mean time , all medical and med's will be covered 100% . I have been on WC for over 4 years , and they are JUST beginning to discuss settlement . If you reach MMI , then mediation is set , to bring the whole case currect ( meaning making sure all dr.'s , test , med's , ETC are PAID in full .) then , pre-trial , and possibiliy trial .... Seems your hubby is a long way from settlement at this point . HAS any of his Dr.'s said or PUT him at MMI ? If not , they feel he is NOT healed , or reached Max. medical improvement .

Once your husband is put at MMI , he is rated at a certain % of disability . At that time , settlement of this case begins .
