    Default Dissolving a Right of Way

    In Massachusetts, will putting in a new driveway on your property automatically dissolve an existing right of way through your neighbor's property?

    is the other right of way a written easement? If so, then no, it does not automatically remove the first easment (unless there is verbiage in the grant that would do so) BUT since easements are often given (sold) to allow access where there normally isn;t or things such as sharing a driveway, the neighbor could possibly sue to have the easement removed. (doesn't mean he would be successful)

    To many possibilites. not enough info.

    Sit down with a local real estate attorney and have them look at everything. They will be able to read the grant and such and should be able to make a reasonable call.
