    Default Quit Claim Without the Knowledge Of The Grantee

    Florida.
    My ex boyfriend and I bought a house together about a year ago and he recently decided to vacate and move home. The note was in his name only but we were both on the deed. I could not afford the mortgage alone and he repeatedly told me he was going to allow the bank to take it. So I moved out and quit claim deeded my interest to him so that I was not liable for anything that occured after I left. He was not aware of this until recently and is now threating to sue me for fraud. I do not believe I was fraudulent in any way as I followed instructions and signed, had witnessed and notarized and recorded. Does he have a leg to stand on? Thanks for the speediest reply, as I cannot sleep for the worry.

    Could some one please tell me if I signed a quit claim deed as the grantor with out the knowledge of the grantee for the sum of ten dollars am I wrong in any way?

    Excuse me. Your first post is time stamped at after midnight; your second one at 6 in the morning. This is not Time Warner; operators are not standing by 24/7 to answer your call. How about a little patience? At least give people a chance to wake up.

    You never delivered the deed to the grantee? You just wrote it up and recorded it without his knowledge?

    While I can understand your ex-boyfriend's objection to that improper process, why does he claim it to have been "fraud", and what financial harm does he claim that he has suffered as a result of the conveyance?

    I am assuming the Clerk's office sent it to him by mail as they requested his address.
    He is under the impression that I by doing so, I have left him holding the bag but it is my understanding that I was not on the note so was not liable to begin with. Am I correct in that assumption?

    You are correct. Although you are on the deed you are not on the mortgage. If they foreclose it will be against him. Anybody can sue anybody but it does not appear he has any claim.

    He is threatening criminal charges for me filing the quit claim deed any chance of that?
