    Question Tricked Into Conveying Property Into Spouse's Living Trust

    Both my hysband and I lost our spouses with cancer in 1992. We met at a grief meeting and were married in 1994. We live in Michigan. My husband is very wealthy. He set up a prenuptial agreement saying that if I outlived him by six months I would receive our residence. My husband is presently 79 and I am 70. His son and the attornys tricked me into signing a warrenty deed to give all rights to the home back to his living trust. They worded it so I did not know what I was signing. His son is a trustee of the living trust. This was in 2002 and I just found out two weeks ago. I also found out Feb.2006 that my husband had been seeing a "lady friend" for years and says he will continue doing so. Is there anything that I can do. My husband says he will not change the warrenty back as originally planned. Is there any help for me? Annie

    Prenupts can sometimes be voided if he is seeing a "lady friend." Take all of the paperwork to your own attorney.

    In Michigan, a prenuptial agreement must be reasonable both at the time it is executed and at the time of the divorce. The law recognizes that circumstances can change.
