Hi. I recently moved out of my CA apartment in which I lived for three years and put down a 1500 dollar security deposit. I put in my 30 days notice which I have a certified mail reciept for. My landlord called and told me that he wanted to come take a look at the condition of the apartment but missed two appointments to do so. When I called to ask why he didn't show he said that he was too busy and that there was no way that he could give me an accurate account of any damage until I moved out anyway. This seems to be in violation of my right to a pre-move out inspection, which I recieved no notice of. It has now been 28 days since move out and he has not contacted me at all. He does not have my forwarding address, but does have my cell phone number which has had uninterupted service, and I haven't heard from him at all. I am waiting to contact him until I know what my rights are. My two questions.. 1)would I have a right to get all my deposit back regardless of damage since I was denied my pre-move out inspection and it has been over 21 days since move out. 2) would I have any legal right to sue for any more since he has not contacted me or returned my deposit 28 days after move out.
