    Default Conditional Discharge and a Criminal Record

    How long does a conditional discharge stay on the record. I am applying for jobs and thought it would be ok since i wasnt convicted, but now I see they are asking if I have ever plead guilty or charged with a crime. And can employers see what you were discharged for?

    I received a conditional discharge for marijuana pariphernalia over three years ago in NJ. How long with this stay on my record and who can see it?

    You can expect that your record will show the original charge, and the disposition. You can expect your criminal record to last a lifetime. Exactly what appears? Whether you can seek an expungement? That depends on the laws of your state.

    If it is on your criminal record, anybody who obtains your criminal record can see it. Criminal records normally last a lifetime.

    I live in NJ. I know you can get it expunged, but do I need a lawyer to get it done? And I've also heard there is something called post conviction relief that I can get done(because I got screwed because I didnt get representation). If I got it expunged would I not be able to get that done later down the road if I wanted to?

    If you can figure out how to handle your own expungement, you can do it yourself.

    Choosing not to have a lawyer represent you will rarely provide a basis for post-conviction relief.

    Well there were so many things that were wrong with the arrest. Like no rights read, the paraphernalia was in another house and someone said it was mine and came next door and coerced me to say it was mine when i was intoxicated(underage drinking ticket to prove it). Do you think that would be enough?

    Yet you stood before a court and entered a guilty plea, and under oath stated facts sufficient to convince the court that you had committed the offense to which you were pleading guilty.

    yes well I was young and stupid and didnt know what I was getting into, I know it was stupid but is there anything I can do.

    If you successfully complete probation and get the discharge, you have no conviction. You can still petition to expunge your arrest records. I understand that there is only a six month waiting period to petition following the successful completion of a conditional discharge program for a drug offense.
