    Smile Car Accident Bodily Injury Claim

    Hello,
    I was in an accident on 4/3/07- I rear-ended a car who hit another car in front of her. Blurry vision caused me to hit the car in front of me, resulting in my car to be totaled. I groped for my cell phone and called 911 and I was taken to the ER and received medical attention.
    Today, I received a letter from my insurance telling me that there is a bodily injury claim filed from that accident.
    My question is: Is there a cap for how much someone can claim for bodily injury? The acident was not out of negligence on my part. I'm new in Nevada and would like to know more about the law here.
    When the ambulance came, I asked the paramedic to check the other car, which he did and he said she was fine.

    Most bodily injury claims are settled within the at-fault driver's policy limits. However; if they want a larger amt., they can sue you in court. It doesn't seem like she was seriously injured from your post. Most people settle out of court because of the time it takes to go to court & they also sometimes have uninsured & *underinsured* coverage on their policy if the at-fault driver's ins. policy limits is not enough.

    Thank you for your response. You're right. My insurance called to tell me that she received a letter from the lawyer of the other side, asking what my limits are. Of course, my insurance didn't tell them, they are working on settlement.
