Default Assault in the public schools
We live in NY . my 17yr old Girl was hit in the back of the head By a 17 year old boy. he used a large hard cover text book and it made her pass out. she was brought to the hospital. The school did very little to the boy. how long ? what is the time limit to file assault charges. and can I Sue the school for failure to protect?

Did you (or somebody else) file a police report? If so, the matter is probably already under consideration for possible assault charges. If not, file one.

What could the school have done to protect her? Other than assigning her a body guard, was there some REASONABLE act that the school could have taken to protect her?

As was mentioned, what prior knowledge did the school have that this assault was likely to occur?
