Default Florida Paternity Law
I have a daughter in which I solely take care of without her mother's support. I am not married to the mother and legal I don't have custody or parental rights because I didn't get a paternity test done. The mother now agrees to sign papers to give me custody. What form do I need to get. Also would this stand firm.
In addition, would it be better to continue on my original plan to file for paternity and get a test done and go to court.

Default Establishing Paternity
You can establish your paternity under Florida law either by affidavit (available from your county department of health or the Department of Children and Families) or through a legal action (form and instructions, PDF format).

To get the custody arrangement to "stand firm" your best bet is to have a court order defining the parenting time arrangement. You may wish to consult a local family lawyer. If you bring a court action you can get a custody order once you have been determined to be the father.
