Failure To Use Headlights

NJ - got a ticket for Failure to Use Headlights - thing is - I have a 2006 Subaru Legacy which has Daytime Running Lights, which turn on with ignition and are the same lights that are used for nighttime driving - I tried to explain this to officer but he said my lights weren't on and I turned them on while he was walking to my car, which wasn't true - there are three positions for my lights and one turns on tail lights, which I guess weren't on - but my headlights were on and remain on all the time. This is clearly explained in the manual and I am wondering if I should plead not guilty and argue this one?

You wern't using your headlights. You were using your daytime running lights.

Your taillights were not on. With your car your dash will be very bright and the radio controls won't be lit up. Did you not notice this? Also the parking brake will disable your daytime driving lights.
