Question Filing a False Police Report With an Affidavit
I have a boyfriend who is in jail (in texas)cause i filed a false police report that he beat me. I only did this so he could get arrested and i would have enough time to get my things out of his house which i was living because i thought i would get hurt by him due to the big fight we just had. I was scared of him because he always told me about his past and i didnt want it to happen to me. So i went to the d-a's office to file an affidavit in which it does tell the whole truth compared to the police report which is false. He was already on probabtion so now he's in there for violating his parole because i lied now i have a affidavit telling the truth and a police report lieing. Someone plzz tell me what to do i have a 1 and a 4 yr old im scared and i have to see a d-a tomorrow about the whole thing on tryna go about dropping the charges...plzz help and if so what do you think will happen with me cause i never been in trouble with the police a day in my i have a life clean record this is all new to me in only 23 help!!!

It is possible that the DA could file criminal charges against you for the false report. If you have any possible means of speaking with a criminal defense attorney, you should do so faster than immediately.

Just for future reference or for others in similar situations, an alternate course of action might have been to have the police show up to calm the immediate crisis, gathered a few things for the night and either gone to a hotel, friend's house, or your local domestic violence shelter. Then you could have obtained a restraining order (doesn't matter that it's his house) and asked police to do a standby while you gathered belongings. Leaving an abusive relationship or one where you are in fear requires a little forethought and safety planning to be able to leave under circumstances where the victim doesn't have to resort to filing false reports to get out. You might also contact your local domestic violence program and ask if they have legal aid available.

what do you do when the police report has wrong information and the DA has file charges against somebody who is in probation? how do you correct those mistakes on the report?

You go to court and testify truthfully as to what happened. The report is not evidence - the testimony of the parties involved, and the physical evidence seized or recorded, IS evidence.
