    Default How Long Do They Have To Return Seized Items

    I am a convicted sex offender I pleaded guilty to 1 single count of child molestation 2nd degree. in Washington in 1996.it was on my niece. I was sentanced to 6 months and I had to do three years of sex offense counsoling. They released me from all obligations in 2000 as I had paid everthing and completed the classes. In january of 2003 my 16 year old daughter moved in with me and my neighbor had a fit. She, the neighbor called a bunch of state offices and county offices to try and stop me from my daughter living here.

    In June of 2003 the sheriffs office did a surprise search warrent at my house when I was home and at the same time they jerked my daughter out of school by the state cps workers and a sherriff and the high school princlepal. They told her the had a person tell them that I had taken nude pictures of her and put them on my computer. This never happened. My daughter denied this and told the cps workers that she wanted to stay with me. Mean while the sherriffs have taken my computer and a journel I was required to keep in 1997 thru 2000 as part of my offender program. That is all they took, I was not arrested and I turned down the officers requet to talk to him. After the left the state allowed my daughter to come home that same day. The next day I hired a good attorny. And then nothing. When I inquired of my lawyer in2004 he said the prosacuter had decided there was no evidance for a chare of any kind. Since then I have recieved from the court and prosacuter a certificate and order of a dischage reterning all m civil rights except firearms back to me. At what poin do they have to return my journel? I could care less about the computer cause it is now way out of date. But I would like my journel back.

    It doesn't sound like they have any plan to return the seized items. You or your attorney can contact the prosecutor's office, or bring a motion for return of the items. Although I have no way of knowing if this has occurred, given that three years have passed since the case was closed, it is possible that the items have been destroyed.
