Default Lender Refuses to Repo
I have a similar problem as with the post by ws617.
however it has become more involved.
I have become ill with cancer and have not been able to work since march of this year, and as a result of the stress within the home my step brother left and I lost that revenue as well. this too, involves citifinancial and they refuse to repo the car. there are other issues at stake that are violations of the fdcpa. I am unable to find an attorney willing to take suit against them in my area. to date I have clearly 172 fdcpa violations, including calling me in the intensive care oncologic unit at the area cancer treatment hospital. to do that they threatened my 11 year old into tears and she said i was in the hospital, they called and said they were my brother, they had no record of any brother as i only have a brother by law from my parents previous marriage, they told the nursing station that they were my brother and I said put him on the phone and it was a collections person from citifinancial, I was on morphine and pretty groggy and told him to let me die in peace and he responded , "I do not care if you die, just pay us first..." anyway I can not get them to take the car back and I can not find an attorney to represent me. what the heck. one can only do what one can do. go figure, this company is listed , I think on hoovers as having 3trillion in assets, you would think they would not participate in these types of tactics. The only income we have at the moment is that of my wifes employment and they are saying that she may loose her job from them calling her work. I have called 32 attorneys with no success.

It sounds like you're no longer dealing with your lender, but either are post-judgment or have a written off debt and are dealing with a company that has purchased the debt. Is that what happened?

No sir,
I am also partially deaf and use tdd, tty and all telephone inbound and out bound spoken word as well as caller id info is converted to text and a journal created. In fact they called my wife and I yesterday at the same time, me at home and she at work and told the person that answered the phone to put the dead beat manager of xxx on the phone. the phones at this place of employment have a called id system that downloads to a computer and keeps the information for 5 years. needless to say, they want to terminate her because of the excessive calling, whether a/n fdcpa violation or not. are you guys aware that they are tracking down people from katrina who's cars actually floated away?

this is the whole point. they refuse to take the car. I would have done this.

As you chose not to tell us your state, and I don't know who your lender is, I don't have anything else I can tell you.
