Accrued Vacation

I have been a full-time employee, accruing vacation since Jan 1 of this year. In November I went part-time. Does my employer have to pay me my accrued vacation, or can they let me use that accrued vacation time up - taking the time off instead of pay since I didn't terminate my employment? I work in IL.

The only law I know of regarding accrued vacation in Illinois is that when you leave their employment, they have to pay out any accrued but unused vacation. I am not aware of any law in any state that dictates to the employer how they must handle vacation with regards to payout vs. using the time off, while the employee is still employed, no matter what their status.

These are the only laws Il. has re vacation earned: If employment contracts or policies provide for paid vacation, the earned, unused portion must be paid to employees at their final rate of pay upon separation.

Employers may cap vacation or require employees to use it by a certain date provided a reasonable opportunity to use it is given.
