    Default Landlord Wants to Increase Rent and Charge Late Fees

    I have lived in my apartment for almost 4 years its a two family house and i have the top floor which is 4 bed rooms i have two levels with two of the rooms upstairs and the only way to get up there is to go through my apartment its not blocked off by anything it looks like any stair case to go up stairs in any home well the problem is my land lord is now trying to tell me if im going to use the upstairs i have to pay $ 100 more this after 3 1/2 yrs of already using the space as i was under that impression that i was renting a 4 bedroom apartment it does not state anywhere in my lease that i can't use the upstairs or that it will be raised if i do also he told me if my rent is late more than ten days that i he's going to charge a 50$ interst fee my question is can he do this ??

    Do you hae a written lease? For what term?

    What state are you in?

    I do have a written lease and i live in MA but it does not specify the number of bed rooms on it

    oh the term is 4/07-4/08 and it just state the landlords name the address of the apartment and that it supplys water and a stove and that it should be returned in good conditon

    If you have a lease that has not yet expired landlord cannot change the terms unless agreed ipon in writing and signed by all concerned parties. If your lease term has not expired he cannot raise your rent
