Default Garnished Wages
I have my wages garnished for 5 years. I struggle each month. It is higher than the 15%. How can I get out of garnishment and pay back at a lower amount?

This will be general info - as aaron stated the garnishment laws are different in each state & you didn't mention your state.

Once a writ of garnishment has been awarded, it is very hard to undo, but not impossible, particularly if the garnishment is eating up too much of your living expenses. If your wages are being garnished and you can't even afford basic necessities of living, then you can file a "Claim of Exemption" form with the court that issued the writ. You can obtain this form at your local courthouse. When you have your day in court, you should bring documented proof of your income and monthly living expenses, such as mortgage or rent payments, utilities, groceries, etc., in order to convince the judge to set aside the writ of garnishment.

If the garnishment isn't reversed, it's possible the garnishment amt. *might* be reduced.

I live in South Dakota. I once called a 800 number and they told me if I pay on top of what they garnish (600.00 mo) I can get this garnish taken off. Have you heard of such a thing? What is a reasonable amount. My take home pay is 700-750.00 after deductions. How do I find out the court that issed the writ?? I was just told my wages were being garnished.
