Default My Thirteen-Year-Old Daughter Assaulted Me
I am in NYS. My 13 year old daughter assaulted me and I was covered in blood. She punched me in the face, then hit me and kicked me and then repeatedly hit me over the back of the head with a stereo. The blood was pouring off of me. There was a puddle of blood on the floor and my face was covered in it. I showered which I really shouldn't have done but I did but not before I took pictures of the blood puddle and my face and injuries. The police said they were not going to charge her but only said they will call in a CPS report. I want her charged with assault but they refused. She also has a bruise. The cops assumed that the pool of blood was hers and said "Your mother really did a job on you, didn't she?" Then my daughter said it was the other way around. The sargeant refused to press charges on her and just called in a CPS report. Can I file criminal charges on her anyway even though the cops didn't go ahead with it? Can I contact the district attorney? I want her out of my house and even if that means for her to go to a group home or in foster care. I have 2 infants and no husband and I am doing the best I can. This whole thing was over her not wanting to do what she was told, her homework and getting out of my bedroom. The cops are obviously biased against the parents in this town and didn't want to hear anything I had to say. But I would like her charged and I am wondering if it is possible.

Sure. Push things with the police. Take it to a supervisor. But you already know how the officers who responded to the scene interpreted things - apparently either as mutual combat or, more likely, as self-defense by your daughter. Don't cry to us if the result is that you are charged with child abuse, or that charges are filed against both of you.
