Default Burdened By Student Loans
II live in PA. I had to leave college before graduating due to serious illness. Took a year to recover. I now have job. I am paying fed student loans and AES loans which amount to 180 per month. My monthly debt to income is even. I have 5 month old son. I dont have luxury expenses. 400 rent which includes heat, phone and electric and cooking fuel, no tv, 110 car payment, 70 per week gas to work right now. With food and baby necessities, I have nothing left each week. I have a sallie mae private loan 200 per month. I have sent them a fee of 150 to defer 3 times. Now they call 5-6 times a night. I dont even have an active checking account and they keep wanting a check number and to be authorized to take funds out of checking even though I tell them I just dont have the money...period. Last night they told me that repeated calling is not harrasment because they are the "first secured collector"? My son is ill with ear infection and they call until I take phone off hook. I dont even have money for an attorney. I would pay if I could. I am an honest person who owes a debt.

Is threre any recourse here to at least get someone to listen to me at sallie mae can I get the calls to stop. I wrote a letter telling them about my situation with an income and expense statement and telling them to stop calling with no effect

You can try contacting your lenders to try to get your loans held in abeyance due to hardship.

You can send them a certified letter telling them that they are to no longer contact you. This will probably have the effect of them filing suit for the loan and legal fees and interest, but even with a court judgment you can't get blood from a stone.

If you can afford to send them anything at all, you can try to get them to agree to accept partial payment, but you MUST get this agreement in writing before sending any payment at all (and IMHO never, ever give them permission to automatically debit any account. If they take more than they agree to you won't be able to get it back since legally you owe them the money. No, they shouldn't have taken it, but you have no defense).
