    Default Can I Legally Get My Car From My Co-Borrower

    I purchased a car for my fiance at the time due to his bad credit and the agreement he would refinance the car into his name and make all payments. I signed as Borrower and he signed as Co-Borrower. I live in California and he lives in Texas and he has the car in Texas. I put the down-payment on the car and have made every single payment on the car for over a year now because I realize I am liable for the loan and he hasn't attempted to make one payment of even pay me back. The loan was made through my bank where I have a long term relationship. The registration is listed in my name with his below and has my California address. In addition, he's been illegally driving on the toll road so I just paid $800 in violations to save my credit. I have no control over what he is doing with the car and every month I get "surprised" by new bills I have to pay because of him. I doubt he even has insurance on the car so now I will be paying for car insurance, the car payment and additional toll violations and I have no way to stop him and no car to show for all this money. Do I have first right to the car to be able to basically have someone "repo" it from him right now? If not, can I refi the car in my name without him knowing and have the car picked up since I can prove I have been financially responsible for the car and am the main borrower? I need to get this car back in my possession desperately. Any ideas??????

    I just applied to get a copy of the title so I will let you know exactly what it says once I receive it in the mail.

    The title reads as:

    My name
    Co-borrower name
    My address

    Unfortunately, no there is no "and" or "or" just my name first and his name underneath mine. I also have a copy of my sales contract and it has my name listed in the buyer section and his listed in the co-buyer section. All monthly payment notices are addressed to my name only. That's really all the paperwork I have. I've asked for clarification from the lending institution on how my co-borrower is listed on their paperwork and am awaiting a response.
