    Default Getting Firearm Rights Restored

    Convicted of a 245 in 1995, only run in with the law ever not even as juvenile. Served 6 mos in county jail, almost 2 yrs ago went before the court and got the felony reduced to a misdemeanor and then dismissed the same day. All rights restored except firearms. Anything I can do? Is there ANY grey area when they look at one's case i.e. the circumstances involved in the altercation? Please help, crime rates rising and Wife and I are having our first child...thanks

    Ah hell Aaron, sorry, that would help right?..lol. It is California...matter of fact, a side note, two blocks away last night halloween, some thugs rang the doorbell of a house and shot the guy answered it, appears to be gang related but still too close to home. I mean I live in a really nice neighborhood (well subdivision) but it's kinda close to the naughty side of town.

    Looking into pardons, it appears that you cannot get your firearms rights restored through even a "full and unconditional pardon" if you have been convicted of an offense that involved the use of a dangerous weapon. I am not sure what other options you would have, although perhaps somebody else can suggest an approach.

    Thanks Aaron, I was kind of thinking that I would not be able to restore my right to possess firearms. I just thought if there was a grey area, such as my 245 conviction was that I accidentally hit a bystander while fleeing from a gangmember that just stabbed my friend for looking at him crosseyed. I plea bargained out because I was sooo scared and had never been in trouble before and my public defender kept suggesting I plea. My gut told me back then that I could take it to a jury, but then I was told I was taking a gamble or whatever and well, hindsight is best sight in my case. I just REALLY want to be compliant when it comes to protection of my family LEGALLY. I have not gone there yet, but when people are ringing doorbells on halloween and murdering the guy that answers, well I am a bit concerned. I mean, what if they knock on the wrong door by mistake, and found out it was not the gangbanger they thought it was....arrrrr!!! Talking about it just frustrates me that I even have to think about this.
