Default Statue of limitations in Indiana
I received a letter from an attorney/collection agency threatening legal action on an account that I have failed to pay over the past 3 years. This a contract completed via internet with Icon fitness and was initially set up for direct withdrawal. I cancelled their ability to access my account for payments after they took an additional payment one month and caused a cascade of NSF checks. They denied responsibilty although I presented documentation from my bank as proof. They later turned the account over for collection, and the collection company refused to accept payments. Now, They have a new attorney/collection company with the threatening letters and the phone calls 5 times a day. (yes, 5 times a day). My question is:Isn't there a statue of limitation in Indiana for filing suit to collect this debt? I do want to get this paid to remove it from my credit report, but I have a cash flow problem now that should be resolved by the end of the year ( I was suddenly unemployed 6 months last year and barely escaped loosing my home). Thanks for any info you can provide.

Default Contractual Statute of Limitations
Depending upon whether the contract falls under the general limitations period for a written contract, or the limitations period for a contract for payment of money, the limitations period in Indiana is probably between six and ten years.
