Default What Can a Cosigner Do When a Loan is Being Paid Late Every Month
Im wondering what i can do if anything co signed a student loan for a friend and they pay the loan late every month.

since the signing we have had a fall out and i think there just doing it as harrassment.

we are in minnesota.

at what point can i try to take them to small claims court to get them to pay this on time?

do i have to pay this in full first?

please help anything would be appreciated

Are we able to sue for breach of contract or harrasment due to the contuation of being paid late every month?

Currently she is 60 days late and the loan company hasnt even called us.
if she messed with our contact information is that also a reason to sue or even a crime?

This is very frustrating i can see how debt collectors get in trouble.

This is the potential price of being a cosigner.

She doesn't have a contract with you - she has a contract with the lender. You guaranteed that contract. If she breaches her contract with the lender and the lender comes after you, you can attempt to recover the money at issue from her.

You can make the payments yourself. But, yes, you can sue for the money back. Depending upon the interest rate, you can pay off the loan by taking out another loan.

As a co-signer, you are just as responsible for the debt as she is. Your best bet in order to protect your credit history is to make the payments yourself on time or pay off the loan as suggested. You can then sue her later to get your money back.
