    Default Filing a Quit Claim Deed While Being Sued

    I live in Ohio
    I have alot of money owed in credit card debt,they debt is in my name only,I always paid my debt until my husband got activated in the military after 9/11
    Our pay was really cut and I could never get caught up again
    I have tried to pay what I could and now the debt was bought I assume by attorneys whom I tried to work out affordable plans with and they yelled and told me to refinance my house,they have added on alot of interest and attorney fees
    They are all coming after me in court,can I qui claim deed my home to my husband to protect our home
    we have three small children and I do not want to jepordize their home
    The mortgage is in his name only,and he owes none of this debt thanks

    The creditors would likely attack any such transfer as a "fraudulent conveyance" and, if successful (and they probably would be), they can typically avoid state homestead exemptions or any allowance for your spouse's interest when they attempt to collect against the asset.

    It sounds like what you really need to do is to have your situation evaluated by a bankruptcy lawyer.
