The house was in the process of being built when we agreed to purchase it.
Issue: We have signed a contract to purchase a house. At the time of the contract the community 'features' sheet indicated there was window tining and a 14 seer A/C unit for the homes. During our contract signing this sheet was included and singed by us. When I questioned them on the window tinting not being done and the SEER rating of the A/C unit they indicated there will not be window tint and there would be a lower SEER Rated A/C unit at our house. Also when we recevied a copy of the purchase agreement in the mail, this sheet was missing. (Although we do have copies of the original they provided when we signed)
They then said at the time that the permits were pulled the less effiecient items were the community standard. However, this information was not disclosed prior to the contract signing and 5K deposit as well as we had singed their latest 'features' document which included window tint and a more efficient A/C unit as part of our purchase agreement. (Both things important in Florida)
Their repsonse, which was not timely, was thats the way it and we will send you the community features sheet from the time the permits were pulled. And since we were buying a spec house and they already discounted it that is just how it is.
On a side note, they also did not disclose it was being built in a flood zone until I had asked.
Do I have any legal recourse to force them to put in the items we have signed for and were under the impression we were getting or is it a lost cause?
