    Question Husband to Adopt My Son

    My husband would like to adopt my son.... this past June my sons bio-father passed away.... my son never had a relationship with his father and he never paid child support or tired to see him in my sons 11yrs of life. Is it going to be harder or easier for my husband to adopted my son? Can anyone contest the adoption? And what legally would we have to do? Please if anyone can help it would be wonderful... my son has been waiting for my husband to adopted him for four years now......

    Was the bio father ever determined to be the legal father?
    If so, you can get a copy of the death certificate and should have no problem with the adoption.

    Adoption, even in seemingly simple cases like yours, isn't really a DIY project. Call your state Bar Association to get a referral for a consult with a family law attorney who specializes in step parent adoptions.

    As adoption laws are different in each state and you chose not to identify your state, it is impossible for us to point you to your state's laws. Generally speaking, with the father being deceased, step-parent adoption would be easier, although that can become more complicated if paternity was never established.

    We live in the state of Oklahoma.... His biofather signed the birth cert. a couple of months after he was born. Now he is getting s.s. every month since his biofathers death......that in its self was kinda frustrating because he set it all up for his other kids before he died but not my son....so it sounds like it is going to be pretty easy to get this done.....thank you all for all your advice...
