    Default Moving In With My Girlfriend

    Hello,
    I was wondering if you would be able to help with me a question I have...

    Here's the situation, my girlfriend of a little over a year and I have
    been wanting to move in together for awhile now... problem is she is
    in the middle of a custody hearing. They're doing a background check
    on her ex-boyfriend right now. I live in Boston, MA and she lives
    outside of Toronto. Her lawyer has told her I can't move because it
    could jeopardize her custody over her daughter... so I guess what I'm
    asking is... Can they do that? Tell her that I can't move because of
    the case? I mean they can do a background check on me.. I have no
    violent record of ANY sort... is it possible for them just to say
    "No"? Or does there have to be probable-cause? I've been told by one
    person that they have no say in her 'love-life' at all. If they can do
    that... are there any clauses or loop-holes I could investigate?
    Basically we're not sure how long background checks take and we want
    to just get the move done. We're planning on starting a mortgage and
    I'm opening a web design studio.

    If you can't legally give me any advice on this then sorry for putting
    you on the spot... but if you can.. any help would be greatly
    appreciated. Just trying to see if her lawyer is right in that me
    moving would make her lose the case... even though her ex-boyfriend
    has a history of violence... including assault on minors.

    They're not telling you that you can't legally move in - they're telling you that it may harm your girlfriend's custody case. If she wants to ignore her attorney, jeopardize her custody case, and risk an adverse court ruling, she can roll out the red carpet for you.

    Would that really make that big of a difference since her ex-boyfriend has charges of juvenile abuse and sexual assault?

    That's really something best evaluated by your girlfriend and her attorney.
