    Default Wet Floor at Stop & Shop

    I live in Massachusetts. Quick question--The floor was so soaked that it puddled. A mat was in front of stand, table or whatever they call it--that was the source of the water. The broccolli was surrounded by crushed ice that had melted and soaked through the mat and puddled on the floor. I did manage to catch myself fom hitting the floor--but pulled upper and lower back muscles by doing so. There were no caution signs. I immediately notified a nearby clerk who called the manager/ while waiting for the manager the clerk mopped the floor and put the caution signs out. The manager thought the signs were there, and the floor was only slightly wet--from the mopping. Thank goodness I looked to the side of the same counter and the floor was soaked. I did see my Dr. the next day.

    Someone told me that because I am on w/comp I will only be reimbursed for my expenses--dr. appt. and medication. I was flat on my back for close to 2 weeks. My back is still not 100%.

    Would I be entitled to pain and suffering settlement? Just curious/

    "Someone told me that because I am on w/comp" - you mean, you were injured while working at this store?

    No, I apologize for not being more clear. I was not employed by Stop and Shop. I am on w/comp after an injury in Jan. I slipped at S&S in August. I was a customer. I was told that because I was on w/c that the slip and fall would only cover med bills and nothing for pain and suffering. Any thoughts would be appreciated. Thanks

    You may have a claim for your injuries, whether that's an entirely new injury or an aggravation of your prior injury, despite being on comp. Consult a personal injury lawyer or, if you already have a worker's comp lawyer, discuss it with your lawyer.
