Sued Over A Debt That Will Soon Come Off My Credit Report

I am being sued for a debt that will soon come off credit report in 2008. The account is very old and the last activity was more than 7yrs ago. I live in NJ the accts were in NY. Both SOL are 6 years. The debt has been resold to a Lawyer(collector) they sent me a legal summons to appear in court in the next 20 days. I've never spoken to them or any creditors this popped up after so many years. I am not admitting to the debt and I will raise the SOL as a defense. Are they able to win and garnish my paycheck or liens on my house? Will this create a judgement against me? What should I bring as proof??

Being its as old as it is I am assuming that its a Junk Debt Buyer. I would say deny everything and make them prove their case, time to start doing lots of research bubba if you wanna win.

They cannot garnish wages or impose liens unless and until they obtain a judgment, and even then their actions will be limited by state law.

Do not miss the court date or they will get a default judgment against you. You need to go to court & use the SOL has expired as your defense. If you go to court, only "if" they win will they be able to get a judgment against you & seize any assets that are non-exempt in your state.
