    Unhappy Proof of Residence

    My 19 year old step daughter moved out of our house in Feb of last year to move in with her boyfriend...The relationship did not work out after 1 month and she ended up moving in with friends and living at her sority house as well because she did not want to live in her mothers house either (until she had her new house built).

    Her mother (his ex) built a new house down the street from us and is now claiming that she lives with her. We can see that she is never there during the day and her car is not there at 5am when I leave for work... we know for a fact that she is living with her new boyfriend but has worked out a deal with her mother so they can split the child support payments.

    We went to court and the problem is, even though we can prove that she does not spend the majority of her time at her mothers home, we cannot prove that she is not living there if both her mother and her say otherwise.

    What can we do to PROVE that she is not living there? We live in Ny State

    Hire a PI. However if she is going to college she would still reside with her mother. Are you still responsible for CS under the court order?

    Would the findings of a PI be enough to stand up in court if it shows that she stays at her boyfriends or friends aprtments 5-6 days out of the week and only returns to her mothers home once or twice a week?

    Yes, we are responsible for CS regardless of if she is in college or not until she is 21

    If she is in college, she is not required to live at her mother's house.

    So just to be clear, if she is in school and she is living with her boyfriend, my husband will still have to pay her mother child support?

    Yes, that is correct. If she was in college and living with her girlfriend it also holds true. Or living on campus.

    See page 6 of 6. Since she is in college, she has not emancipated herself.
