Default Assault charge for throwing cereal and milk
The other day I was arrested for throwing milk and rice crispies at my boyfriend of 2 years. What had happened was we got in an argument and he had asked me to leave. I told him no and i then threw the food at him. I did not physically or verbally assault him. However he still wanted me to leave so he called the police. He had told them that he wanted to me to leave, that we had gotten into an argument and he wanted me to leave so that we could both cool down. However, whent the police officer interviewed me I told him about the food throwing. He asked me is I had a place to go and I said yes, but that I didn't want to leave so the police officer arrested me without reading me my Miranda rights. I have already had my arraignment and pleaded not guilty. I am out of jail on bond. What do I need to know/do in order to get this expunged?

Default Battery on Boyfriend (With Cereal)
You should consult a local lawyer about your situation. You may be eligible for a diversion program, such that you won't be convicted of a domestic violence offense.
